D2C Food Brand — Multi-Class Trademark Registration
Challenge
A direct-to-consumer food brand had been operating for 3 years under a brand name without any trademark registration. A competitor filed for a similar trademark in Class 30 (food products), triggering an opposition deadline. The company also needed trademark protection in Class 29 (processed foods), Class 32 (beverages), and Class 35 (retail services) to cover their expanding product line.
Our Solution
Filed an emergency opposition against the competitor's trademark application with evidence of prior use (invoices, marketing materials, and social media presence dating back 3 years). Simultaneously filed 4 trademark applications across Classes 29, 30, 32, and 35 for the client's brand name and logo. Prepared a detailed affidavit of prior use with supporting evidence for the opposition proceedings.
Result
Opposition against the competitor was successful — their application was refused based on the client's demonstrated prior use. All 4 trademark applications were accepted after examination and published in the Trademark Journal. The brand now has TM protection across all 4 classes. Software Company — Patent Filing for AI-Based Algorithm
Challenge
A B2B software company had developed a novel AI algorithm for supply chain optimization. They wanted patent protection in India but were unsure if software/algorithms were patentable under Indian law (Section 3(k) of the Patents Act excludes computer programs 'per se'). Additionally, they wanted to explore international filing under PCT.
Our Solution
Worked with the company's technical team to draft the patent specification focusing on the technical effect and industrial application of the algorithm (not just the code). Structured the claims around the method and system aspects rather than the software per se, to navigate Section 3(k). Filed a complete specification with the Indian Patent Office and simultaneously filed a PCT application for potential international expansion.
Result
Indian patent application was accepted after a single examination report response — the Controller accepted the argument that the invention produced a technical effect beyond a mere computer program. PCT application was filed covering 3 priority countries. The company used the patent-pending status in client proposals, which they reported helped in closing 2 enterprise deals.
